1. SERVICE DESCRIPTION

1.1 ServiceDogCards.com ("we," "us," "our") provides digital identification credentials ("ID Card") for service dogs.

1.2 The ID Card is a digital pass compatible with Apple Wallet and Google Wallet that documents self-declared service dog status.

1.3 This is a voluntary documentation service. No law, including the Americans with Disabilities Act (ADA), requires service dog handlers to possess, carry, or present any form of identification, registration, certification, or documentation.

2. CRITICAL DISCLAIMERS

2.1 NOT A GOVERNMENT DOCUMENT

• This ID Card is NOT issued, endorsed, approved, or recognized by any government agency, including but not limited to the U.S. Department of Justice, state agencies, or local authorities.
• No official government service dog registry, certification, or identification system exists in the United States.

2.2 NOT AN ADA CERTIFICATION

• This ID Card does NOT certify, register, or validate a dog as a service animal under the ADA or any other law.
• This ID Card does NOT grant, confer, or create any legal rights, protections, or accommodations under the ADA or any other law.
• Possession of this ID Card does NOT substitute for an animal meeting the legal definition of a service animal.

2.3 SELF-DECLARATION DOCUMENTATION ONLY

• This ID Card solely documents the handler's self-declaration of their dog's service animal status.
• We make no independent verification of the dog's training, behavior, or suitability as a service animal.

2.4 NO LEGAL REQUIREMENT

• Under the ADA, handlers are NOT required to show documentation of any kind.
• Businesses may only ask: (1) Is this a service dog required for a disability? (2) What task is the dog trained to perform?
• Businesses cannot require handlers to present this or any identification card.

3. USER ACKNOWLEDGMENTS

By purchasing this service, you acknowledge, understand, and agree that:

• 3.1 You have read and understand that no government service dog registry exists.
• 3.2 This ID Card is for informational and convenience purposes only and is not legally required.
• 3.3 This ID Card does not create, grant, or imply any legal rights under the ADA or other laws.
• 3.4 You are solely responsible for understanding and complying with all applicable laws regarding service animals, including the ADA.
• 3.5 Presenting this ID Card does not obligate any business or entity to grant access or accommodations.
• 3.6 You will not misrepresent this ID Card as a government document, official certification, or legal requirement.
• 3.7 You will not use this ID Card to fraudulently represent a pet or emotional support animal as a service dog.

4. ELIGIBILITY & ACCURATE INFORMATION

• 4.1 This service is available to individuals who self-declare their dog as a service animal.
• 4.2 You represent and warrant that all information provided (dog name, handler name, photo) is true, accurate, and complete.
• 4.3 Providing false information is grounds for immediate revocation without refund.

5. PAYMENT & FEES

• 5.1 The one-time fee for this service is $9.99 USD (subject to change).
• 5.2 Payment is processed through Stripe. By purchasing, you agree to Stripe's terms of service.
• 5.3 All sales are final. No refunds will be issued except as required by law or at our sole discretion.
• 5.4 We reserve the right to change pricing at any time. Price changes do not affect previously completed purchases.

6. LICENSE & RESTRICTIONS

6.1 License Granted

We grant you a non-exclusive, non-transferable, revocable license to use the ID Card for personal documentation purposes only.

6.2 Restrictions

You may NOT:

• Sell, transfer, or share your unique access link with others
• Reproduce, duplicate, or create derivative works of the ID Card design
• Use the ID Card for any commercial purpose
• Modify, alter, or tamper with the ID Card
• Remove or obscure any disclaimers or legal notices on the ID Card
• Misrepresent the ID Card as an official government document
• Use the ID Card to perpetrate fraud or misrepresentation

7. REVOCATION RIGHTS

• 7.1 We reserve the right to revoke, deactivate, or invalidate any ID Card at any time, with or without notice, for any reason, including violation of these Terms, fraudulent or false information, misuse, or request from law enforcement.
• 7.2 Revocation does not entitle you to a refund.
• 7.3 Upon revocation, the verification page will display that the ID Card is no longer active.
• 7.4 We are not liable for any consequences resulting from revocation.

8. NO WARRANTIES

8.1 THE ID CARD AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

8.2 WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• That the ID Card will be accepted by any business or entity
• That the ID Card will prevent access denials or confrontations
• That the ID Card will function on all devices or wallet applications
• That the service will be uninterrupted or error-free

8.3 We make no guarantees about how third parties will respond to or accept the ID Card.

9. LIMITATION OF LIABILITY

9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF ACCESS, EMOTIONAL DISTRESS, LEGAL FEES, OR HARM TO REPUTATION.

9.2 OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID ($9.99).

9.3 Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

10. INDEMNIFICATION

10.1 You agree to indemnify and hold harmless ServiceDogCards.com, its owners, employees, and agents from any claims, damages, or expenses arising from your use or misuse of the ID Card, violation of these Terms, or any fraudulent use of the service.

11. USER RESPONSIBILITIES

• 11.1 You are solely responsible for understanding and complying with all applicable service animal laws.
• 11.2 You acknowledge that possession of this ID Card does not guarantee access to any location.
• 11.3 You agree not to misrepresent a pet or emotional support animal as a service dog.

12. PRIVACY & DATA

• 12.1 We collect and store: dog name, handler name, dog photo, and payment information.
• 12.2 Dog photo and information are displayed on the public verification page when the QR code is scanned.
• 12.3 We do not sell your personal information to third parties.
• 12.4 Payment information is processed by Stripe and subject to Stripe's privacy policy.

13. INTELLECTUAL PROPERTY

• 13.1 All content, design, trademarks, and branding are owned by ServiceDogCards.com.
• 13.2 You may not use our name, logo, or branding without written permission.

14. MODIFICATIONS TO TERMS

• 14.1 We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting.
• 14.2 Continued use of the service after changes constitutes acceptance of modified terms.

15–19. TERMINATION, NO PROFESSIONAL ADVICE, COMPLIANCE, SEVERABILITY & ENTIRE AGREEMENT

• We may terminate your access at any time without notice.
• This service does not provide legal, medical, or professional advice.
• You agree to use this service in compliance with all applicable laws.
• If any provision is unenforceable, the remaining provisions remain in effect.
• These Terms constitute the entire agreement between you and ServiceDogCards.com.

20. GOVERNING LAW & DISPUTE RESOLUTION

• 20.1 These Terms are governed by the laws of the State of Delaware.
• 20.2 Any disputes shall be resolved in the courts of Delaware.
• 20.3 You waive any right to a jury trial.
